This week Judicial Watch on by behalf sent a letter to AG Brnovich asking him to sue ABOR for clearly breaking Arizona law and if does not file it within 60 days we will and we will ask for damages, all costs, and give it back to taxpayer. Letter not at

Prop. 300 passed by over 75% of voters in 2006, a majority of every single demographic. They said NO to the dream act of any subsidy at all. Any aid given to those in the country illegally is a violation of Arizona law and Federal law. The media is on the attack, and are offended that we believe in the rule of law and respect the 75% of the voters who firmly said “NO” TO THE DREAM ACT. It is time we hold them accountable for spending millions of taxpayer dollars as they break the law, violate their Oaths of Office and treat illegal aliens better than “citizens” who legally come to Arizona to attend our colleges and Universities. Chapter 14 – Provisions Relating to Both Community Colleges and Universities

Article 1 – Classification of Students for Tuition Purposes

15-1803. Alien in-state student status
(Caution: 1998 Prop. 105 applies)
A. An alien is entitled to classification as an in-state refugee student if such person has been granted refugee status in accordance with all applicable laws of the United States and has met all other requirements for domicile.
B. In accordance with the illegal immigration reform and immigrant responsibility act of 1996 (P.L. 104-208; 110 stat. 3009), a person who was not a citizen or legal resident of the United States or who is without lawful immigration status is not entitled to classification as an in-state student pursuant to section 15-1802 or entitled to classification as a county resident pursuant to section 15-1802.01.
C. Each community college and university shall report on December 31 and June 30 of each year to the joint legislative budget committee the total number of students who were entitled to classification as an in-state student and the total number of students who were not entitled to classification as an in-state student under this section because the student was not a citizen or legal resident of the United States or is without lawful immigration status.

Article 2 – Admission of Students

15-1825. Prohibited financial assistance; report
(Caution: 1998 Prop. 105 applies)
A. A person who is not a citizen of the United States, who is without lawful immigration status and who is enrolled as a student at any university under the jurisdiction of the Arizona board of regents or at any community college under the jurisdiction of a community college district in this state is not entitled to tuition waivers, fee waivers, grants, scholarship assistance, financial aid, tuition assistance or any other type of financial assistance that is subsidized or paid in whole or in part with state monies.
B. I stand firmly with the laws of this state and nation. I pride myself in standing up for the citizens of this nation and state and for the Oath of Office we take to defend and support the Constitution and the laws.

Yes, the Arizona Board of Regents voted to grant illegal aliens in-state tuition in direct violation of federal law and Arizona law and a great cost to Arizona taxpayers. Proposition 300 passed in 2006 by 75% of Arizona voters that said NO to the Dream Act. But, heck they never let voters or the law stand I the way of their agenda. It is amazing that we would and do ignore the damage to this Constitutional Republic and its citizens by promoting illegal policies that threaten everything our Founders and hundreds of thousands of Americans have died for. And the crying and gnashing of teeth over the fact that they are illegal and face removal from this country as the law requires.
