They whine about needing more money, when actually someone ought to go to jail. They have openly decided to break the law and spend millions to educate illegal aliens at taxpayers’ expense all in violation of the law.

So one must ask do they need more money? Do we ignore the millions they choose to spend illegally? Do we reward them for throwing the law and the voters under the bus? The law is clear the voters spoke loud and clear at the ballot box when they passed Proposition. 300 by 73%. A majority of every single demographic. But the Board of Regents and the Community Colleges have decided to side with Obama instead of the Arizona taxpayer and voters.

They have decided to spend millions of dollars illegally. What they are doing is in direct violation of the law. NOT ONE MORE PENNY. Somebody should go to jail, not rewarded.
Should we even be surprised at the lack of respect for the law or the taxpayer? Does it even count as news anymore? Again, no real surprise. Arizona law that is clear and concise and that was passed and approved by more than 72% of the voters. Yet the Board of Regents who has a legal and moral obligated to the taxpayers has decided to go with the illegal order by Obama and to hell with the taxpayers or the law. Whoops, legal and moral don’t mix with the left or the Arizona Republics agenda.

You should be outraged, you should be outraged at the judges like Judge Arthur Anderson who in violation of the Constitution and the law, legislate from the bench and rewrite our laws? You should be outraged at the Community Colleges who want more money and yet want to illegally subsidized education to those illegally in Arizona? You should be outraged at the Arizona Board of Regents that happily ignored the law and passed in-state tuition for illegal aliens?

It is illegal?

Proposition 300 passed by 73% of Arizona voters codified federal law into state law: federal law is clear ” … In accordance with the illegal immigration reform and immigrant responsibility act of 1996 a person who was not a citizen or legal resident of the United States …is not entitled to classification as an in-state student …” Then Arizona law states, “A person who is not a citizen of the United States, who is without lawful immigration status … is not entitled to tuition waivers, fee waivers, grants, scholarship assistance, financial aid, tuition assistance or any other type of financial assistance that is subsidized … with state monies.”

When are we going to hold activist judges accountable to the People and the Constitution?

The Arizona Republic celebrated the May 5th decision from Maricopa County Superior Court Judge Arthur Anderson who rejected the law and the will of the people. Judge Anderson actually wrote the words “The circumstance under which a person enters the U.S. does not determine that person’s lawful presence here.” Like Herman Cain said, “you can’t fix stupid!”

What astounding ignorance by the lawyer with a robe. The circumstance under which a person enters or remains in the U.S. is the single greatest factor in determining whether or not their presence is lawful. Would the judge write that “The circumstance under which a person dies does not determine whether that person was murdered or not”? It would be as logically unsound, yet it would certainly attract widespread condemnation and scorn. So why does the Arizona Republic cheer judicial lawlessness? Those who come in violation of the law are “illegal,” and federal law makes that very clear. State law reaffirms it.

Those who come illegally are not entitled to in-state tuition and in fact prohibited by law from receiving in-state tuition.

I bet his decision would be different if he was actually elected and held accountable by the People. The so called “merit selection system” is a system with no accountability. It is a political process, only We the People are left out and the unelected bureaucrats choice your judge and a “retention” election is held a few years later, but designed to make sure you cannot remove any of them and of course no opposing candidate to talk about their record.

The cost for our failure to control the border is huge: Illegal aliens, including Dreamers, are committing murders and other violent crimes every day. Yet instead of compassion for their victims, the left in this country tries to convince us that those here illegally are themselves the victims. Yes, readers of the Arizona Republic ought to feel genuine outrage, but not at the manufactured fiction they pass off as news. They ought to be outraged that the Arizona Republican celebrates rogue judges, the destruction of our laws, and the cost to our state and country of this illegal immigration invasion.

Senator Russell Pearce, former Chief Deputy Maricopa County Sheriff’s Office, former President of the Arizona Senate, and former Judge, author of SB1070, Employer Sanctions, Prop. 100 no bail for violent illegal aliens, Prop 103 English as Arizona’s Official Language, Prop. 300 NO instate tuition for illegal aliens
